Terms of service
The following Terms of Service (“Terms”) outlines the terms and conditions governing the use of WireScreen (“we,” “us,” or “our”) website, or other products, features, and services available on or through our website (collectively the “Services”). By using the Services, all users and visitors agree to abide by the Terms. Please review carefully, as the Terms represent a legal contract between us and users of the Services. If you do not agree to abide by the Terms, do not access or use the Services.
The Services are restricted to the use of persons 13 and older. By using the Services, you agree that you meet these conditions.
Content made available on or through the Services (including but not limited to, articles, reports, illustrations, videos, podcasts, etc.) is intended for personal, noncommercial use, and may not be modified, reproduced, or distributed unless expressly authorized in separate written agreements with us.
All user communications on our site or platforms that we manage may be monitored, including disputes between users. We do not assume liability for your interactions with other users, or their interactions with you.
Visitor and user rights and obligations under the Terms may not be transferred or sold. You will be held responsible for all activity associated with your account, including but not limited to violations of the Terms.
Any violation of the Terms, real or perceived, may result in suspension of access to the Services. We reserve the right to suspend or terminate access to the Services at any time for any reason.
The Services, and all content or elements comprising the Services are protected by copyright, pursuant to U.S. and international copyright laws.
Unauthorized copying or harvesting of the information of our users or content in the Services is prohibited under the Terms. Such prohibited behaviors include but are not limited to:
- Any modifying, republishing, reproducing, distributing, displaying, or otherwise exploiting any part or element of the Services.
- Any attempt to dissemble or reverse-engineer any part of the Services, including any underlying software.
- Any scraping, spidering, or other automated means of collecting information.
- Any attempt to interfere with the Services or the activities of our users.
- Any attempt to collect the personal information of our users.
- Any actions that threaten or present a disproportionately large burden to our network security or infrastructure.
For written consent to use copyrighted content, report a copyright violation, or contact us in regard to any copyright-related inquiries, please email us at firstname.lastname@example.org. As part of the Terms, you agree to report any copyright violations of the Terms to us as soon as you become aware of them.
Users are expected to be respectful in all communications to us and other users on our site and platforms we manage. It is not permissible to submit unlawful, harmful, defamatory, abusive, obscene, or otherwise offensive material.
By uploading material to our site or platforms we manage, visitors and users grant us the right to display such material, as well as irrevocable worldwide, perpetual, royalty-free, exclusive, sublicensable license to use, reproduce, adapt, publish, translate, create derivative works from, and distribute your user content in any existing or future media. Your user content must not be unlawful, or infringe on any third party’s legal rights.
We reserve the right to remove any user generated material on any platform we manage, for any reason.
The Services may feature content owned by third parties, or links to third-party websites. We do not assume responsibility for third-party linked sites, their content, or their policies.
Privacy and Security
We care about the security of your information and monitor the Services for potential attacks and vulnerabilities. However, we cannot guarantee that third parties will not be able to defeat our security measures. By using the Services, you acknowledge that you provide your personal information at your own risk.
Fees and Payments
All information provided in connection with a paid service agreement must be complete and accurate to the best of your knowledge. You will be held responsible for updating or notifying us of any changes to the information you provide.
Upon giving your express consent to enter into a paid service agreement with us, we may collect all or part of the payment amount, including any applicable taxes, at any time, pursuant to the terms of the service agreement.
You may choose to cancel your service agreement with us at any time, in which case your payment obligations will end as of the most recent service period ended (e.g. a monthly subscription cancelled during the month of January will be billed for the service period ended January 31).
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND. THE SERVICES ARE PROVIDED “AS IS” ON AN “AS AVAILABLE” BASIS, AND ARE USED AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WIRE, ITS AFFILIATES AND SUBSIDIARIES, AND OTHER PARTIES INVOLVED IN OFFERING THE SERVICES WILL NOT BE HELD LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES RESULTING FROM OR AS A CONSEQUENCE OF THE USE, MISUSE, OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO:
- ANY INVESTMENT OR FINANCIAL DECISIONS VISITORS OR USERS MAKE AS A RESULT OF INFORMATION ON OUR SITE OR PLATFORMS WE MANAGE.
- ANY UNAUTHORIZED ACCESS TO THE SERVICES AND ANY PERSONAL INFORMATION STORED THEREIN.
- ANY BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR, TRANSMITTED VIA THE SERVICES BY ANY THIRD PARTY.
- ANY INTERRUPTION OF THE SERVICES.
- ANY VIOLATION OF THE INTELLECTUAL PROPERTY RIGHT OF ANY PERSON OR ENTITY.
- ANY USER CONTENT OR THE CONDUCT OF THIRD PARTIES.
- ANY ERRORS OR OMISSIONS, MISTAKES, OR INACCURACIES OF CONTENT.
THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF THE WIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GRANTS YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
Governing Law and Jurisdiction
The Terms shall be construed and enforced in accordance with the laws of the United States of America and the state of Massachusetts.
By using the Services, you waive any claims that may arise under the laws of other jurisdictions, and are responsible for compliance with applicable United States and local laws and regulations.
By using the Services, you agree to hold The Wire and any of its affiliates or subsidiaries harmless from any losses or damages resulting from a violation of the Terms.
Updates to the Terms
We reserve the right to update the Terms from time to time, and may do so without prior notice. Your use of the Services following a change to the Terms will be subject to the updated Terms.
